Privacy Statement

1. This privacy policy (“Privacy Policy”) describes how we manage your Personal Data in compliance with the Personal Data Protection Act 2012 of Singapore. We encourage you to read this Privacy Policy in its entirety so that you know and understand the purposes for which we collect, use and disclose your Personal Data.

2.By using this website, you are consenting to the collection and use of Personal Data in the way we describe in this policy.

3.This Privacy Statement applies when you use our website to find information about Schülke & Mayr (Asia) Pte. Ltd. (the “Company”) and our products. It is applicable to Personal Data collected by the Company.

4.We may update this Privacy Policy from time to time. Subject to your rights at law, you agree to be bound by the prevailing terms of this Privacy Policy as updated from time to time. We encourage you to check the latest version of this Privacy Policy regularly.

5.Personal Data” refers to data, whether true or not, about an individual who can be identified from that data, or from that data in combination with other information to which the Company may have access to or which you have provided to the Company including your name, age, telephone number, email and mailing address

6.This Privacy Policy does not supersede or replace any other consents you may have previously or separately provided to us in respect of your Personal Data, and your consent to this Privacy Policy is in addition to any other rights which the Company may have at law to collect, use or disclose your Personal Data.

7.This Privacy Policy and your use of this website shall be governed by and construed in accordance with the laws of the Republic of Singapore.

Collection, use and disclosure of Personal Data

8.In general you can visit our website on the Internet without revealing your identity or providing Personal Data. Information collected and stored during normal use of the site is used to monitor use of the site and assist in its further development. Such use does not result in any Personal Data being collected or stored.

9.Certain pages in our website may allow us to collect and process Personal Data that you provide for specific purposes. You will be asked to provide information about yourself when you use certain site facilities, in order to complete your request or transaction. In connection with the foregoing, you warrant and represent to us that:-

(a) such Personal Data which you disclose to us is accurate and complete; and

(b) where you volunteer Personal Data of another person to us, you are authorised by such other person to disclose such Personal Data to us, and that such Personal Data is accurate and complete.

10. We use this data to provide you with the information, products or services that you request from us and to communicate with you. We may keep a record of any contacts you have with us. We may use the information that you provide for record keeping, statistical or research purposes.

11. We only retain this information where required to do so by law; for the length of time needed to provide the service or information you have requested (including any retention period specified by law or by government policy), or for the length of time that you choose to store information or permit us to contact you if you have registered with our website.

12.If you have provided us with your Singapore telephone numbers and have indicated that you consent to receiving marketing or promotional information via your Singapore telephone number, then from time to time we may contact you using such Singapore telephone numbers (including voice calls and text messages) with information about our products and services.

13.Your Personal Data may be transferred, stored and/or processed in a country or territory outside Singapore and you consent to any such transfer storage and/or processing of your Personal Data outside Singapore. We will however ensure that any party to whom we transfer your Personal Data outside Singapore provides to such Personal Data a standard of protection at least comparable to the protection under the Act. This includes ensuring that any party coming into contact with the Personal Data outside Singapore:-

(a)complies with the Act and relevant regulations and this Privacy Policy and shall not do or permit anything to be done which might cause such party to breach the same;

(b)Protects such Personal Data by making reasonably security arrangements to prevent unauthorised access, use and disclosure.

Withdrawal of consent and access

14. You may withdraw your consent to our continued use and disclosure of your Personal Data or seek access to your Personal Data (to a reasonable extent and as permitted by the Act) at any time by writing to at the contact details below. You may also withdraw your consent for specific forms of communication and on specific communications via the unsubscribe options as stated on our email or other marketing messages.

15. In withdrawing your consent, you acknowledge that we may not be able to provide or continue providing certain goods and/or services to you and that we may cease such provision accordingly without any liability. Please note that it may take up to 30 working days for any request for consent withdrawal to be reflected in our systems.

16.We will, at your request, endeavour to provide you with an account of your Personal Data in our possession or control within a reasonable time. Such account shall be in respect of how your Personal Data has been or may have been generally used or disclosed within the year before the date of your request.   We reserve the right to charge a reasonable administrative fee for carrying out your request.

Accuracy and correction

17. We will endeavour to ensure that your Personal Data we use is sufficiently accurate and complete in making any decision that impacts you.

18.To help us maintain the accuracy of your Personal Data, we encourage you to inform us when there are any changes to your Personal Data which you have provided us by writing to the Company at the contact details below.  We will correct or complete your Personal Data as soon as reasonably practicable.

Protection, policies and procedures

19. We will endeavour to protect your Personal Data in our possession or control against risks of unauthorised access, collection, use, disclosure, copying, modification, disposal or destruction, through reasonable and appropriate security measures. We strive to ensure that our systems are secure and that they meet industry standards.

20. To prevent unauthorised access, maintain data accuracy and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the Personal Data we collect.

21. Notwithstanding our security measures for protecting your Personal Data, you acknowledge that no data transmission over the Internet is completely secure and by providing your Personal Data, you are transmitting information at your own risk.

Using cookies

22. Certain websites employ an industry-wide technology called cookies. On this website we use cookies that are necessary for the use of the website. A cookie is a text-only string of information that a website transfers to the cookie file of the browser on your computer's hard disk so that the website can remember who you are. A cookie will typically contain the name of the domain from which the cookie has come, the 'lifetime' of the cookie, and a value, usually a randomly generated unique number.

23. Two types of cookies may be used on this website; 'session cookies', which are temporary cookies that remain in the cookie file of your browser until you leave the site, and 'persistent cookies', which remain in the cookie file of your browser for much longer (though how long will depend on the lifetime of the specific cookie).

24.  When you visit our website you’ll be sent a cookie. Cookies may be used in the following ways:

  • To help us recognise you as a unique visitor when you return to our website and to allow us to tailor content or advertisements to match your preferred interests or to avoid showing you the same adverts repeatedly

  • To compile anonymous, aggregated statistics that allow us to understand how visitors use our site and to help us improve the structure of our website. We cannot identify you personally in this way.


25.Our website uses Google Analytics, a web analytics service provided by Google, Inc.. Google Analytics uses cookies to compile anonymous, aggregated statistics as described above. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

26.We have integrated the Google Tag Manager on our website, an auxiliary service which itself only processes personal data (IP address) for technically necessary purposes. The Google Tag Manager takes care of loading other components, which in turn may collect data. The Google Tag Manager does not access this data. You can find more information about the Google Tag Manager in Google's privacy policy.

27.We also use the Google Signals service to create cross-device user statistics (e.g. numbers, user groups) and to play out cross-device remarketing campaigns for Google users. Google only processes the data of users who have activated the "personalised advertising" option in their Google account settings. You can also object in principle to the collection by Google Signals by deactivating the "personalised advertising" function in your Google account.


How to disable & enable cookies

28.Each website can send its own cookie to your browser if your browser's preferences allow it, but to protect your privacy your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites. You do not have to accept cookies. You can decide if you want to accept cookies by changing the settings on your browser to accept all cookies, reject all cookies, or notify you when a cookie is set.

29.You have the ability to accept or decline cookies by modifying the settings in your browser. However, please note that if cookies are disabled, you may not be able to use all the interactive features of our site. Please note that our web pages may then not be displayed and some functions may no longer be technically available if cookies are disabled.

32.We may also collect the domain name and email addresses of visitors to this website and those that communicate with us via email. We may also collect other aggregate information, e.g. information about the pages users access or visit and the transactions they perform there and any other information volunteered by the user, such as survey information and/or site registrations. We can also identify the web browser that the user is using and the way in which the user has accessed our website, e.g. via a particular hyperlink or link contained within a marketing email.

 33.The information we collect in this way is used for internal review and improvement purposes, e.g. to improve and/or customise the content, and/or layout of our websites for our users or each individual user. This information is not shared with other organizations for commercial purposes.


Control your privacy needs

34.Some modern browsers have a feature that will analyse website privacy policies and allow a user to control their privacy needs. These are known as 'P3P' features (Privacy Preferences Platform).

35.You can easily delete any cookies that have been installed in the cookie folder of your browser. For example, if you are using Microsoft Windows Explorer:

  2. click on the 'Search' button on the tool bar

  3. type "cookie" into the search box for 'Folders and Files'  

  4. select 'My Computer' in the 'Look In' box  

  5. click 'Search Now' Double click on the folders that are found

  7. hit the 'Delete' button on your keyboard  

 

36.If you’re not using Microsoft Windows Explorer, you should select 'cookies' in the 'Help' function for information on where to find your cookie folder. The Interactive Advertising Bureau http://www.allaboutcookies.org/ is an industry body, which develops standards and guidelines to support online business processes. Its website gives further details about cookie, web beacons and such-like, and explains how they can be managed and disabled.

 

Data Protection and Information Security

37.We follow strict security procedures for obtaining, processing and storing the personal information with which we have been entrusted.

38.We will not disclose or make your personal information available to a third party (otherwise than where indicated within this privacy policy) without your consent.

39.We will also correct or delete any inaccurate information that we are holding about you that is brought to our attention.

Links to other websites

40.This website may contain links to other third-party websites with whom we have a relationship. However, we are not responsible for these websites and their privacy practices. We therefore suggest that you read the privacy policy statements on any website that you visit from a link on this site, as their policies and procedures may differ from our own.

 

Embedded videos

41.To ensure that calling up the website with embedded videos does not automatically lead to content from the third-party provider being reloaded, we only display thumbnails of the videos in a first step. This means that the third-party provider does not receive any information. 

42.Only after a click on the preview image is the content of the third-party provider loaded. This provides the third-party provider with the information that you have accessed our site as well as the technically necessary usage data. In addition, the third-party provider is then able to implement tracking technologies. We have no influence on the further data processing by the third-party provider. By clicking on the preview image, you give us your consent to reload content from the third-party provider.  

43.The embedding is based on your consent, provided that you have given your consent by clicking on the preview image. Please note that the embedding of many videos leads to your data being processed outside Singapore. In some countries, there is a risk that authorities may access the data for security and monitoring purposes without you being informed or having any legal recourse.

 

Usage data

44.When you visit this website, so-called usage data is temporarily evaluated on the web server for statistical purposes as a protocol in order to ensure the security and utilisation of the server as well as to improve the quality of the website. This data record consists of

  • the name and address of the requested content,

  • the date and time of the request,

  • the amount of data transferred,

  • the access status (content transferred, content not found),

  • the description of the web browser and operating system used,

  • the referral link, which indicates the page from which you came to ours,

  • the user's internet service provider,

  • the IP address of the requesting computer, which is shortened in such a way that it is no longer possible to establish a personal reference.

    The aforementioned log data is only evaluated anonymously.

Data security

45.In order to protect your data from unwanted access as comprehensively as possible, we take technical and organisational measures. We use an encryption procedure on our website. In order to protect your data transmitted via our website, we use SSL encryption. You can usually recognise this by the fact that the lock symbol is closed in the status bar of your browser and the address line begins with https://.


YouTube / Google (USA)

46.For transfers to the USA, an adequate level of data protection is guaranteed due to the certification of the provider under the adequacy decision (EU-U.S. Data Privacy Framework). If you have clicked on a preview image, the content of the third-party provider is immediately reloaded. If you do not wish such reloading on other pages, please do not click on the thumbnails anymore.

Online trainings

48.In addition to offering reading training courses, we also offer personal online training courses for which we use telephone/video conferences (hereinafter: "online training courses") via "Teams" of the US provider Microsoft Corporation.

49.If you also voluntarily provide personal information when using the tool or voluntarily use functions that are not mandatory, the associated data processing is based on your revocable consent. You can revoke your consent at any time with effect for the future. Please note that processing that took place before the revocation is not affected by this.

50.Depending on the type and scope of the use of the tool, different types of data are collected or processed. This includes in particular

  • Personal data (e.g. first and last name, e-mail address, profile picture)

  • Training metadata (e.g. date, time and duration of communication, participant IP address, MAC address, other device IDs (UDID), device type, operating system type and version, client version, camera type, microphone or speaker, type of connection)

  • Text, audio and video data (e.g. chat histories, video and audio playbacks)

  • Connection data (e.g. phone numbers, country names, start and end times, IP addresses).

51.If you have registered for an online training course, you will receive an access link from us by e-mail or calendar entry. Trainings You can participate in the online training direct via the browser without installing the apps. The service is then provided via the website by the respective service provider, whereby the service provider is responsible for data processing.

52.You are free to use the chat functions during the online training. Likewise, you can decide whether to activate your camera and/or microphone or leave them switched off. If you use the chat function, the text entries you make will be processed in order to display and log them in the online training if necessary. If you switch on your camera or microphone, the data from the microphone of your terminal device and from any video camera of the terminal device will be processed for the duration of the training.

53.Please note that training sessions will make your personal details visible to all other participants and any information you or others upload, provide or create during an online training session will be processed for the duration of the training and will remain stored after the online training has finished. If you have a Microsoft Teams account and use it and the Microsoft Teams app to dial in, the name stored there will automatically be displayed in the participants list for everyone to see. If you do not want this, use the option of participation via the browser window. There you can enter a pseudonym. There is no possibility of central deletion of the online training by the host. We therefore recommend that you as a participant do not use the chat function if you wish to prevent storage in the online training.

54.Under certain circumstances, we may record individual online trainings for the purpose of documentation or further publication afterwards on the schülke academy. Both the audio track and the camera view of the participants can be recorded. You are free to activate the camera and microphone. Before the recording begins, we will inform you of this and of the intended place of publication, if any. By continuing to participate under the settings you have chosen, you hereby declare your consent to the possible recording and further use. If you participate without activating the camera and/or microphone, none of your personal data (except for your user name or pseudonym) will be recorded. You can then also ask questions via the chat. The chat contents are not part of the recording. It is possible to revoke your consent with effect for the future, provided it is technically possible to remove your personal data from the recording

55.When processing your data, we are supported by the following as external service providers and processors:

 User account

56.In order to use our offer of the schuelke-academy and to participate in trainings, it is necessary to create a user account via the website. These data are required for registration

  • Master data (first name, last name)

  • Access data (access code, user name, e-mail address, password)

    Further details are voluntary and will only be processed on the basis of your consent. You can revoke this consent at any time for the future.

57.In the course of registration and subsequent logins and uses of the user account, we store the IP addresses of the customers along with the access times in order to be able to prove registration and prevent any misuse of the user account.

As part of the contractual use of the user account, the following data is generally processed:

  • User data (e.g. first name, last name, user name, e-mail address, password, further data that the user additionally sets in his profile such as company, department, language).

  • Course data (e.g. name of the course, course content, course slides, quiz questions and answers, rotation, start time, linked participants, completed participations, participating user groups)

  • Attendance data, (e.g. course and user concerned, attendance record, start time, completion time, attendance status (e.g. completed, open).

Users receive regular e-mail notifications from us with information about their unfinished course participation. It is also used for password recovery.

When a created user participates in a course, the following information is regularly collected and stored:

  • Start time of the course

  • slides viewed, each with start time and end time of page view

  • Answers given to quiz questions

  • Time of completion of the course

  • Certificate of attendance

58.This participation data is used to ensure that the user has viewed or edited all course content (e.g. slides, quizzes, texts) before the participation status is set to "completed" and a participation certificate is generated. The participation certificate contains the name of the user, the name of the course and the completion date of the participation. The certificate of attendance is made available to the user in the "My courses" area. There is an option to download the participation certificate, which the user should make use of. The responsible party accepts no liability for the storage and provision of the participation certificate.

59.Data associated with a user account will be retained for the time that the account is maintained. In the event of prolonged inactivity of the user account, we reserve the right to contact you by e-mail to verify that the user account has been maintained. If no e-mail is deposited or in the absence of a reply or a reply to the contrary within 7 days, the user account and the attached data will be deleted. 

60.Once you have created a user account, you can have it deleted by us at any time without incurring any costs other than your own data transmission costs if any. A message in text form (e.g. e-mail, fax, letter) to academy.sg@schuelke.com  or to the contact details given in the imprint is sufficient for this. Please state "Unsubscribe schülke Academy" in the subject line.  We will then delete your stored personal data, insofar as we do not still have to store it due to legal retention obligations. It is the user's responsibility to save relevant data beforehand if the user account is cancelled. The legal basis for the processing of this data is your consent in accordance with Personal Data Protection Act 2012 of Singapore.

Contact

61.We process your data that you transmit to us in connection with contacting us by e-mail, telephone or fax exclusively for processing your request. Our legitimate interest follows from the aforementioned purpose to process and answer your request.

Data recipient

62.We pass on your personal data within our company to the areas and persons who need this data to fulfill the respective purpose. Insofar as this is necessary within the framework of the purposes outlined above, we may also transfer your personal data to companies affiliated with us. Your data will not be passed on to third parties, i.e. outside the schülke Group, as a matter of principle or only if this is permitted under data protection law.

63.In the context of commissioned processing, we may also pass on your data to external service providers (e.g. for hosting, IT services, marketing and sales) who support us in our data processing processes strictly in accordance with instructions and on the basis of a commissioned processing agreement. We take care to ensure that data processing is limited as far as possible to within the European Union (EU) or the European Economic Area (EEA), e.g. by selecting storage locations at appropriate data centers in the European Union. Insofar as data is also processed outside the EU or the EEA or transferred to third-country service providers, the transfer will only take place insofar as the third country has been confirmed by the EU Commission as having an adequate level of data protection, an adequate level of data protection has been agreed with the data recipient (for example, by means of standard contractual clauses) and, where applicable, further necessary measures have been taken to ensure an adequate level of data protection, or you have given us your consent to do so.

64.We use this website as a browser-based e-learning web application (Software as a Service), which is provided by reteach of Susell GmbH (Rosenthaler Strasse 38, 10178 Berlin, Germany) in accordance with the order processing agreement.
